Local Planning Instruments

Forbes Shire Council has implemented planning documents which relate to the creation of a quality environment for the Forbes community in which land use and development is planned and controlled. Environmental planning aims to enhance and develop the social and environmental well being of the community.

Forbes Local Environment Plan

Forbes Shire Council Local Environmental Plan 2013 (LEP) is the statutory planning instrument for the Forbes Shire.  The Forbes LEP 2013 details the specific zoning information relating to all land within the Forbes Shire, with the exception of the Bathurst Street area for which the Forbes Local Environmental Plan 1986 still applies, and regulates the type of development which is permissible within each zone.

Aims and Objectives

This plan aims to make local environmental planning provisions for land in Forbes in accordance with the relevant standard environmental planning instrument under section 33A of the Act. The particular aims of this Plan are as follows:

  • To encourage and manage ecologically sustainable development in Forbes,
  • To reinforce the existing urban character of Forbes as the urban focus,
  • To reinforce the rural character of Forbes while promoting sustainable development,
  • To protect the agricultural land of Forbes for continued agricultural production while allowing for planned expansion at the urban fringe,
  • To promote Forbes as a premier tourist-destination building on its unique heritage and environmental attributes as well as sporting and leisure facilities,
  • To protect, enhance and conserve the natural environment, including the Lachlan River, Lake Forbes, wetlands, native vegetation, environmentally sensitive land and other natural features that provide habitat for fauna and flora, provide scenic amenity and prevent or mitigate land degradation,
  • To provide a range and variety of housing choices to cater for the different needs and lifestyles of residents.

Forbes Development Control Plans

Forbes has a single Development Control Plan (DCP) that applies to the Shire. Within this DCP there are a number of chapters specific to the planning and management of development within the Forbes Shire. The DCP complements Council's statutory planning controls the Forbes Local Environmental Plan (LEP) 2013. The Development Control Plan is available from Council's Administration Building at 2 Court Street, or downloadable via the links below.

Planning Proposals

The following information is for applicants proposing an amendment to the Forbes Local Environmental Plan 2013 (LEP). To propose an amendment to the Forbes LEP, applicants must prepare a Planning Proposal. A Planning Proposal is a comprehensive document which explains the intended outcomes and justification for a proposed amendment to the LEP. Applicants should review the following documents before preparing a Planning Proposal.

Council encourages prospective applicants to discuss their proposals with Council’s Town Planner as early as possible to seek feedback on matters that are specific to their proposal. To book a pre-Planning Proposal Meeting call the Planning and Growth department on 02 6850 2300. 

Voluntary Planning Agreements

A Voluntary Planning Agreement (commonly called a VPA or planning agreement) is an agreement entered into by a planning authority, such as Forbes Shire Council and a developer in relation to either a Planning Proposal or a Development Application. A planning agreement is a voluntary agreement under which the developer has agreed to provide or fund public amenities or public services. This can include:

  • dedication of land
  • monetary contributions
  • construction of public infrastructure
  • provision of materials for public benefit and/or use,
  • or a combination of the above

A planning agreement can either be in lieu of, or in addition to a development contribution payments and this is negotiated and specified as part of the planning agreement. A planning agreement cannot be entered into, and a planning agreement cannot be amended or revoked, unless public notice has been given of the proposed agreement, amendment or revocation, and a copy of the proposed agreement, amendment or revocation has been available for inspection by the public for a period of not less than 28 days.

Sec 7.12 Contributions Plan

Section 7.12 of the Environmental Planning and Assessment Act 1979 (the Act) allows a levy, based on a percentage of the development cost, to be imposed when a development consent or complying development certificate is issued. Levies paid to Forbes Shire Council will be applied towards the provision, extension or augmentation of public facilities, or towards recouping the cost of their provision, extension or augmentation.

Variations to Development Standards Register

Under Clause 64 of the Environmental Planning and Assessment Regulation 2000, Council may assume the NSW Department of Planning’s Director-General’s concurrence in relation to an application to vary a development standard. This is under State Environmental Planning Policy No.1 (SEPP1) and Clause 4.6 of Forbes Local Environmental Plan 2013, subject to maintaining a register and reporting these variations to the Department of Planning. The following SEPP 1/Clause 4.6 variations have been approved by Council:
