Planning & Development

Planning and Development within the Forbes Shire is managed by Council's Environmental Services & Planning Department. This Department is responsible for:

  • Development Applications for Buildings
  • Development Applications for Subdivision
  • Development Applications for other works/land useage
  • Asset Management
  • Building Assessment
  • Building Construction and Supervision
  • Development and Building Compliance
  • Planning and Assessment
  • Illegal Building Works / Complaint Investigations
  • Planning and Development in NSW

    Planning and Development in NSW is carried out under the Environmental Planning and Assessment Act 1979 (EP&A Act) and the Environmental Planning and Assessment Regulation 2000 (the Regulation). Both State and Local Government have roles and responsibilities under the EP&A Act to ensure that our built and natural environments are developed in appropriate and sustainable ways. The Act provides for different levels of development regulation and guidance relating to State, Regional and Local issues through the following statutory and non-statutory environmental planning instruments:

    STATUTORY

    • State Environmental Planning Policies (SEPPs)
    • Regional Environmental Plans (REPs)
    • Local Environmental Plans (LEPs)

    NON-STATUTORY

    • Development Control Plans (DCPs)
    • Local Policies & Codes

    State, regional and local environmental planning instruments indicate what level of assessment is required for development and who is responsible for assessing a development proposal. SEPPs & REPs are administered by the Department of Planning while Council administer LEPs, DCPs and local policies & codes.  For most types of building, subdivision and demolition work, a Development Application (DA) is required to be submitted to Council for approval. In some cases the consent of Council may be required for the change of use of land or premises (eg when an existing shop is converted to a restaurant).
